With all the legislation surrounding property lettings, we thought it may be useful for Self-managed Landlords to know what they MUST be doing and what they SHOULD be doing...
The following are MANDATORY items i.e. the Landlord must be compliant:
🟢 Obtain a relevant Licence from the local council
🟢 Provide a Tenancy Agreement - minimum 6 months
🟢 Landlord's full name and correspondence address to be supplied to Tenant (unless Tenancy managed by Letting Agency)
🟢 Maximum 5 week Tenancy Deposit (for annual rents of less than £50,000)
🟢 Deposit Protection Certificate
🟢 Only charge Permitted Tenant Fees, click

🟢 Present the latest 'How-to-Rent' Guide to their Tenant
🟢 Carry out a Right-to-Rent check
🟢 If holding Client Money, Landlords must provide evidence of Client Money Protection (CMP)
🟢 If handling Tenant personal data, Landlords must be register with the Information Commissioner’s Office (ICO) an provide a privacy notice explaining how they will use, store and dispose of Tenant data
🟢 When gaining Vacant Possession, Landlords must provide the correct notices in the prescribed format and time frames
🟢 Landlords can only legally remove a Tenant by obtaining a court order for possession and arranging for a warrant to be executed by bailiffs - click here for more information
Safety items
🟢 Gas safety certificate (one copy of this certificate must be left in the property)
🟢 Electrical Installation and Condition Report (EICR)
🟢 EPC Rating E or above
🟢 Smoke alarm (one per floor)
🟢 CO monitor (in all rooms that have a fixed combustion appliance)
🟢 Legionnaire's risk assessment
🟢 Check regularly to ensure that all products, fixtures and fittings are safe
🟢 Fitness for human habitation - the property must be healthy and free from things that could cause serious harm
🟢 Maintain the structure and exterior of the property
🟢 Ensure the property is free from serious hazards throughout your tenancy
🟢 Deal with any problems with the water, electricity and gas supply
🟢 Maintain any appliances and furniture they have supplied
🟢 Seek Tenant permission to access the property by giving at least 24 hours’ notice
🟢 Consider requests for reasonable adjustments from Tenants who have a disability or long-term condition
In addition to the list above, Landlords SHOULD ensure the following items are in order:
🟠 Mortgage Consent to Let
🟠 Buildings and Contents Insurance (to include Public Liability)
🟠 Tenant Credit Check
🟠 Tenant Employment Reference
🟠 Previous Landlord Reference
🟠 Provide an inventory and meter readings
🟠 Dilapidation check at the end of the Tenancy
