With all the legislation surrounding property lettings, we thought it may be useful for Landlords to know what they must be doing to say compliant β
The following are mandatory items i.e. the Landlord must be able to evidence that they have been done:
π’ Obtain a relevant Licence from the local council
π’ Provide a Tenancy Agreement - minimum 6 months
π’ Landlord's full name and correspondence address to be supplied to Tenant (unless Tenancy managed by Letting Agency)
π’ Maximum 5 week Tenancy Deposit (for annual rents of less than Β£50,000)
π’ Deposit Protection Certificate
π’ Only charge Permitted Tenant Fees, click here for more information
π’ Present the latest 'How-to-Rent' Guide to their Tenant
π’ Carry out a Right-to-Rent check
π’ If holding Client Money, Landlords must provide evidence of Client Money Protection (CMP)
π’ If handling Tenant personal data, Landlords must be register with the Information Commissionerβs Office (ICO) an provide a privacy notice explaining how they will use, store and dispose of Tenant data
π’ When gaining Vacant Possession, Landlords must provide the correct notices in the prescribed format and time frames
π’ Landlords can only legally remove a Tenant by obtaining a court order for possession and arranging for a warrant to be executed by bailiffs - click here for more information
Safety items
π’ Gas safety certificate (one copy of this certificate must be left in the property)
π’ Electrical Installation and Condition Report (EICR)
π’ EPC Rating E or above
π’ Smoke alarm (one per floor)
π’ CO monitor (in all rooms that have a fixed combustion appliance)
π’ Legionnaire's risk assessment
π’ Check regularly to ensure that all products, fixtures and fittings are safe
π’ Fitness for human habitation - the property must be healthy and free from things that could cause serious harm
π’ Maintain the structure and exterior of the property
π’ Ensure the property is free from serious hazards throughout your tenancy
π’ Deal with any problems with the water, electricity and gas supply
π’ Maintain any appliances and furniture they have supplied
π’ Seek Tenant permission to access the property by giving at least 24 hoursβ notice
π’ Consider requests for reasonable adjustments from Tenants who have a disability or long-term condition
In addition to the list above, Landlords should ensure the following items are in order:
π Mortgage Consent to Let
π Buildings and Contents Insurance (to include Public Liability)
π Tenant Credit Check
π Tenant Employment Reference
π Previous Landlord Reference
π Provide an inventory and meter readings
π Dilapidation check at the end of the Tenancy
