What you need to know
๐ธ Wednesday 17th May 2023: the Renters Reform Bill (RRB) was published by the Government (which was first promised all the way back in 2019)
๐ธ The wide-reaching reforms have been described by the Government as a 'once-in-a-generation overhaul' of housing law
๐ธ Central to the bill is how Landlords will be able to evict Tenants by abolishing no-fault evictions (known as Section 21 evictions)
๐ธ Currently under Section 21, Landlords can evict Tenants without providing a reason - under the new bill, Landlords will have to provide a valid reason for eviction
You do not need to do anything at all - rest assured, we're already all over it and are planning a seamless integration of the new rules โ
When do we expect the bill to commence?
๐ธ 2024 at the earliest (in our opinion)
๐ธ The bill will need to pass through parliament before becoming law
๐ธ With the government's proposals now revealed, it will start its journey through the House of Commons and House of Lords, before receiving Royal Assent which is when it formally passes into law
๐ธ This process will likely take months, so it's very unlikely the reforms will not be implemented until 2024
The changes under the RRB are proposed as follows:
๐ธ Tenants will legally be allowed to ask for a pet, Landlord would have to provide 'good reason' to refuse (Landlords will be able to require pet insurance to cover any damage to their property)
๐ธ It will become illegal for Landlords to have a blanket ban on families with children
๐ธ Also, Landlords will not be able to ban Tenants in receipt of benefits
๐ธ The Decent Homes Standard will be introduced to the Private Rented Sector for the first time (which currently applies to social housing)
๐ธ Discussions taking place about scrapping Fixed Term Tenancies, replaced by monthly Periodic contracts
๐ธ Anti-social Tenants will be easier to evict as the list of activities are broadened
๐ธ The government also plans to strengthen councilsโ enforcement powers and introduce a new requirement for local authorities to report on enforcement activity. This is hoped to crack down on criminal landlords.
๐ธ There will also be a reformed digitised courts process reducing delays for the minority of evictions that do end up in the courts
๐ธ Landlords will still be able to increase their rent once per year, however they must register with a new ombudsman which will intervene in severe cases (currently, only Letting Agents are required to join an ombudsman scheme)
๐ธ Also there is talk of Landlords registering on to a new online property portal, envisaged to enable Landlords to understand their legal obligations better
So, how will a Landlord regain possession of their property in 2024?
๐น Landlords will still be able to evict Tenants for anti-social behaviour or rent arrears (notice period to be confirmed)
๐น Also, evictions will be granted for Landlords to move themselves into their property, or their family (notice period to be confirmed)
๐น Landlords will also be permitted to evict Tenants should they wish to sell the property (notice period to be confirmed)
That's the summary for now, clearly the devil will be in the detail - as we know more, we will share with you without delay.
