Which Landlord regulations are mandatory and which aren't? πŸ€·β€β™€οΈ

With all the legislation surrounding property lettings, we thought it may be useful for Self-managed Landlords to know what they MUST be doing and what they SHOULD be doing...

The following are MANDATORY items i.e. the Landlord must be compliant:

βœ” Obtain a relevant Licence from the local council
βœ” Provide a Tenancy Agreement - minimum 6 months
βœ” Landlord's full name and correspondence address to be supplied to Tenant (unless Tenancy managed by Letting Agency)
βœ” Maximum 5 week Tenancy Deposit (for annual rents of less than Β£50,000)
βœ” Deposit Protection Certificate
βœ” Only charge Permitted Tenant Fees, click here for more information
βœ” Present the latest 'How-to-Rent' Guide to their Tenant
βœ” Carry out a Right-to-Rent check
βœ” If holding Client Money, Landlords must provide evidence of Client Money Protection (CMP)
βœ” If handling Tenant personal data, Landlords must be register with the Information Commissioner’s Office (ICO) an provide a privacy notice explaining how they will use, store and dispose of Tenant data
βœ” When gaining Vacant Possession, Landlords must provide the correct notices in the prescribed format and time frames
βœ” Landlords can only legally remove a Tenant by obtaining a court order for possession and arranging for a warrant to be executed by bailiffs - click here for more information

Safety items

βœ” Gas safety certificate (one copy of this certificate must be left in the property)
βœ” Electrical Installation and Condition Report (EICR)
βœ” EPC Rating E or above
βœ” Smoke alarm (one per floor)
βœ” CO monitor (in all rooms that have a fixed combustion appliance)
βœ” Legionnaire's risk assessment
βœ” Check regularly to ensure that all products, fixtures and fittings are safe
βœ” Fitness for human habitation - the property must be healthy and free from things that could cause serious harm
βœ” Maintain the structure and exterior of the property.
βœ” Ensure the property is free from serious hazards throughout your tenancy.
βœ” Deal with any problems with the water, electricity and gas supply.
βœ” Maintain any appliances and furniture they have supplied.
βœ” Seek Tenant permission to access the property by giving at least 24 hours’ notice
βœ” Consider requests for reasonable adjustments from Tenants who have a disability or long-term condition.
In addition to the list above, Landlords SHOULD ensure the following items are in order:

βœ” Mortgage Consent to Let
βœ” Buildings and Contents Insurance (to include Public Liability)
βœ” Tenant Credit Check
βœ” Tenant Employment Reference
βœ” Previous Landlord Reference
βœ” Provide an inventory and meter readings
βœ” Dilapidation check at the end of the Tenancy
