With all the legislation surrounding property lettings, we thought it may be useful for Self-managed Landlords to know what they MUST be doing and what they SHOULD be doing...
The following are MANDATORY items i.e. the Landlord must be compliant:
β Obtain a relevant Licence from the local council
β Provide a Tenancy Agreement - minimum 6 months
β Landlord's full name and correspondence address to be supplied to Tenant (unless Tenancy managed by Letting Agency)
β Maximum 5 week Tenancy Deposit (for annual rents of less than Β£50,000)
β Deposit Protection Certificate
β Only charge Permitted Tenant Fees, click

β Present the latest 'How-to-Rent' Guide to their Tenant
β Carry out a Right-to-Rent check
β If holding Client Money, Landlords must provide evidence of Client Money Protection (CMP)
β If handling Tenant personal data, Landlords must be register with the Information Commissionerβs Office (ICO) an provide a privacy notice explaining how they will use, store and dispose of Tenant data
β When gaining Vacant Possession, Landlords must provide the correct notices in the prescribed format and time frames
β Landlords can only legally remove a Tenant by obtaining a court order for possession and arranging for a warrant to be executed by bailiffs - click

Safety items
β Gas safety certificate (one copy of this certificate must be left in the property)
β Electrical Installation and Condition Report (EICR)
β EPC Rating E or above
β Smoke alarm (one per floor)
β CO monitor (in all rooms that have a fixed combustion appliance)
β Legionnaire's risk assessment
β Check regularly to ensure that all products, fixtures and fittings are safe
β Fitness for human habitation - the property must be healthy and free from things that could cause serious harm
β Maintain the structure and exterior of the property.
β Ensure the property is free from serious hazards throughout your tenancy.
β Deal with any problems with the water, electricity and gas supply.
β Maintain any appliances and furniture they have supplied.
β Seek Tenant permission to access the property by giving at least 24 hoursβ notice
β Consider requests for reasonable adjustments from Tenants who have a disability or long-term condition.
In addition to the list above, Landlords SHOULD ensure the following items are in order:
β Mortgage Consent to Let
β Buildings and Contents Insurance (to include Public Liability)
β Tenant Credit Check
β Tenant Employment Reference
β Previous Landlord Reference
β Provide an inventory and meter readings
β Dilapidation check at the end of the Tenancy
