Under the scheme, it is a legal requirement for Landlords to hold a Selective Licence for each rental property they have that falls within the designated Selective Licensing areas.
Nottingham City Council has confirmed a second scheme for Selective Licensing that starts on 1st December 2023...
The first scheme that commenced on 1 August 2018, was originally introduced as part of the 2004 Housing Act. It lasted for 5 years, and according to Nottingham Council came into force to raise safety and living standards for Tenants in the Private Rental Sector, making Landlords more accountable for maintaining their properties.

Under the scheme:
๐น A privately rented property could fall under the Selective Licensing scheme if there is: one occupant, more than one occupant who form one household (e.g. a family) or two unrelated individuals who form two households (e.g. two friends)
๐น The scheme covers flats as well as houses
๐น The cost of the second scheme selective licence is ยฃ887 per property, this is reduced to ยฃ665 for Accredited Landlords (follow Nottingham Council's link below for further details)
๐น The fee will need to be paid at the onset of the licence period
๐น The Selective Licence must be applied for before Tenants move into a property and just like the first scheme will again last for 5 years
๐น Under the first scheme that ran from 1 August 2018 โ 31 July 2023, the council will continue to inspect properties whose licence runs beyond 31 July 2023
๐น Although the areas for Selective Licensing remain similar, some areas have changed. You can find out if your property falls with the designated area
here๐น It is against the law to rent out a property that falls under the scheme if you donโt have a Selective Licence. As such, failure to comply has serious repercussions including a financial penalty notice of up to ยฃ30,000 or an unlimited fine from the court
๐น You could also have control of your unlicensed properties taken away from you, and be ordered to repay up to 12 months rent to the council or your Tenants
๐น The deadline for applying for the second scheme licence is 1st December 2023 if your current licence has already expired.
๐นIf your current licence hasn't expired, you can apply submit your new licence application any time prior to the initial expiration date
If your details or circumstances have changed:
๐น A licence variation is also available for changes that need to be made to an existing licence, this includes a change of contact address, conditions to a licence where works have been carried out, or details of a new property manager
๐น There is also a Temporary Exemption Notice (TEN) for property sellers. This exempts a Landlord from needing a licence if they are in the process of selling a property in a designated Selective Licencing area
